Mars Rover Curiosity Celebrates 1st Birthday Off Earth

NASA's Mars rover Curiosity marked one year away from Earth Monday (Nov. 26), but the car-size robot's work on the Red Planet is just getting started.

Curiosity launched from Florida's Cape Canaveral Air Force Station on Nov. 26, 2011, then endured an eight-month cruise through deep space to the Red Planet. The $2.5 billion rover touched down on Aug. 5, executing an unprecedented series of maneuvers that saw it lowered to the Martian surface on cables by a rocket-powered sky crane.

Since that dramatic landing, Curiosity has driven 1,696 feet (517 meters) and returned more than 23,000 raw images to its handlers here on Earth, NASA officials said. But there's much more to come.

Curiosity is just 16 weeks into a two-year prime mission that aims to determine if its Gale Crater landing site can, or ever could, support microbial life. The rover carries 10 different science instruments to help it in this quest, including one called Sample Analysis at Mars, or SAM, which can identify organic compounds ? the carbon-containing building blocks of life as we know it.

SAM may already have detected something exciting. Curiosity chief scientist John Grotzinger, a geologist at Caltech in Pasadena, told NPR earlier this month that SAM's first tastes of Martian soil are providing data "for the history books."

Grotzinger and others on the Curiosity team will reveal what Curiosity has found on Monday (Dec. 3), during a presentation at the American Geophysical Union meeting in San Francisco.

At the moment, Curiosity is at a site that mission scientists have dubbed "Point Lake," which overlooks lower ground to the east. The rover team is scanning the landscape for targets for the first use of the rover's drill, which can bore 1 inch (2.5 centimeters) into solid rock.

Curiosity's ultimate destination is the base of Mount Sharp, a mysterious mountain that rises 3.4 miles (5.5 kilometers) from Gale Crater's center. These foothills show signs of long-ago contact with liquid water.

The rover could be ready to head toward Mount Sharp's interesting deposits ? which lie about 6 miles (10 km) away ? by the end of the year or so, Curiosity scientists have said.

Salazar Finalizes Reforms to Streamline Leasing, Spur Economic ...

Rule removes roadblocks to residential, commercial, renewable energy development; restores greater leasing control to tribal governments

WASHINGTON, DC ? November 28, 2012 ? (RealEstateRama) ? As part of President Obama?s commitment to empower tribal nations and strengthen their economies, Secretary of the Interior Ken Salazar and Assistant Secretary for Indian Affairs Kevin K. Washburn today announced final regulations that will streamline the leasing approval process on Indian land, spurring increased homeownership, and expediting business and commercial development, including renewable energy projects.

The comprehensive reform, informed by nation-to-nation tribal consultations and public comment, overhauls antiquated regulations governing the Bureau of Indian Affairs? process for approving the surface leases on lands the federal government holds in trust for Indian tribes and individuals. As trustee, Interior manages about 56 million surface acres in Indian Country.

?This reform will expand opportunities for individual landowners and tribal governments to generate investment and create jobs in their communities by bringing greater transparency and workability to the Bureau of Indian Affairs leasing process,? Secretary Salazar said. ?This final step caps the most comprehensive reforms of Indian land leasing regulations in more than 50 years and will have a lasting impact on individuals and families who want to own a home or build a business on Indian land.?

?This reform is about supporting self-determination for Indian Nations and was developed in close consultation with tribal leaders,? said Assistant Secretary Washburn. ?The streamlined, commonsense rule replaces a process ill-suited for economic development of Indian lands and provides flexibility and certainty to tribal communities and individuals regarding decisions on the use of their land.?

The new rule complements and helps to implement the recently-passed Helping Expedite and Advance Responsible Tribal Homeownership Act (HEARTH Act), which allows federally recognized tribes to assume greater control of leasing on tribal lands. The HEARTH Act was signed into law by President Obama on July 30, 2012.

Previous BIA regulations, established in 1961, are outdated and unworkable in today?s economy. They lacked a defined process or deadlines for review, which resulted in simple mortgage applications often languishing for several years awaiting approval from the federal government. These types of delays have been significant obstacles to homeownership and economic development on tribal lands.

The new regulation, effective 30 days after publication in the Federal Register, will fundamentally change the way the BIA does business, in many ways by minimizing BIA?s role and restoring greater control to tribal governments. The final rule provides clarity by identifying specific processes ? with enforceable timelines ? through which the BIA must review leases.

The regulation also establishes separate, simplified processes for residential, business, and renewable energy development, rather than using a ?one-size fits all? approach that treats a lease for a single family home the same as a lease for a large wind energy project.

The new process provides a 30 day-limit for the BIA to issue decisions on residential leases, subleases, and mortgages. For commercial or industrial development, the BIA would have 60-days to review leases and subleases. If the BIA does not complete its review of subleases in this timeframe, those agreements will automatically go into effect.

The new rule increases flexibility in compensations and land valuations, with BIA deferring to the tribe?s negotiated value for a lease of tribal land rather than requiring additional, costly appraisals. Other changes eliminate the requirement for BIA approval of permits for certain short-term activities on Indian lands, and supports landowner decisions regarding the use of their land by requiring the BIA to approve leases unless it finds a compelling reason to disapprove.

Led by Principal Deputy Assistant Secretary Donald E. (?Del?) Laverdure, Interior conducted several rounds of consultation in 2011 and 2012 to develop the proposed and the final regulations. The comments received in writing and during the public meetings helped inform the final regulations being announced today.

Former baseball star indicted for insider trading

LOS ANGELES (AP) ? Former Baltimore Orioles all-star Doug DeCinces and three others were indicted Wednesday on insider trading charges involving the use of information prior to the takeover of a medical device company in California, authorities said.

In 2008, DeCinces was told by a close friend and official at Advanced Medical Optics Inc. that Abbott Laboratories planned to pay $21 to $23 a share for the company's stock, prosecutors said. At the time, Advanced Medical Optics was trading for about $8 a share.

DeCinces began buying Advance Medical stock based on that information and passed along the takeover details to three friends because he wanted to make up for previous investment recommendations that had gone bad, prosecutors said.

When Abbott's offer was made public, DeCinces sold his newly purchased shares and profited about $1.3 million, court documents show. Abbott acquired Advanced Medical Optics in January 2009.

DeCinces' three friends each bought and sold Advanced Medical stock and made anywhere from $140,000 to nearly $350,000, authorities said.

Also indicted on insider trading charges were David Parker, 60, of Provo, Utah; Fred Scott Jackson, 65, of Newport Beach, and Roger Wittenbach, 69, of Lutherville-Timonium in Maryland.

DeCinces, 62, was charged with 42 counts of securities fraud and one count of money laundering. Each of the fraud counts carries a maximum sentence of 20 years in prison. DeCinces is scheduled to appear in court on Dec. 17.

"To put it mildly, we do not agree with the decision to bring a criminal case against Doug DeCinces," said Gordon Greenberg, DeCinces' attorney. "But the proper place to have this resolved is in the courtroom and not on the courthouse steps."

Messages left for the other defendants' lawyers were not immediately returned.

The Securities and Exchange Commission previously filed a civil lawsuit against DeCinces that was settled last year when the former major leaguer agreed to pay $2.5 million. In the lawsuit, federal authorities named James Mazzo, Advanced Medical's former CEO, as the person who told DeCinces about the pending deal.

Mazzo is a senior vice president at Abbott and is not facing criminal charges. In August, in response to the SEC lawsuit, Mazzo's attorney said his client would be fully exonerated after a review of the evidence.

Also caught up in the insider trading case was Hall of Famer and DeCinces' former teammate Eddie Murray, who agreed in August to pay nearly $360,000 to settle federal civil charges. Federal investigators said DeCinces told Murray about the impending takeover. Murray neither admitted nor denied wrongdoing.

DeCinces was a third baseman during 15 seasons with the Orioles, California Angels and St. Louis Cardinals. He currently is president and CEO of a real estate development firm in Orange County.

It also shows incompetence and shoddy work are just as old as civilization or there would be less of a need for codes. Yet codes are only half the process. While they do exist, it does not necessarily mean they are followed by all. Another thing that hasn't changed with civilization's history. Thus the need for over site.

The process used today in many parts of this country, not all, but many, is the permitting and inspection of construction. Basically permits are taken out with the local building department. Then at some point the new construction is inspected by the local building official. When the project meets his or her approval, the permit is closed.

Let me repeat, the permit is closed.

As a home inspector I am inform often that permits were pulled for _____. My response is always the same, "are they closed?" This can at times receive a quizzical look on the face of the one who made the statement.

Recently I inspected a permitted deck. I really have come to despise decks. There is almost always something wrong.

The first glaring defect was the ladder like guard rails and lack of handrails. Stooping to look under the deck at the support structure, I was dumbfounded by what I saw. The main support beam was very noticeably bowing. The reason was very clear, this beam by my estimate is well over 20 feet in length and devoid of an center support. A 4 x 4 post was stationed at each end, nothing any where in between. But wait, it gets better.

Going around to one post of interest, I saw the pier was not squarely on the footing. Looking at the attachment to the beam, I saw four nails. Same on the back side. The support beam was actually two separate boards face nailed to the two posts. The center of this large deck in essence is supported solely on a total of 16 nails.

The best method for constructing a pier beam support is to set the beam on top of the posts. In this way the load is distributed evenly along the beam, with the piers fully supporting the beam, not a set of fasteners.

There were several other issues with this permitted deck, which goes to show, permissible is open to interpretation, especially when circumventing the rules.

MORECAMBE, England (AP) -Manchester City striker Carlos Tevez has been banned from driving for speeding.

Magistrates in the northern English town of Lancaster imposed the interim ban on Monday after he failed to provide identification when he was caught speeding in nearby Morecambe on March 28.

The Argentina international did not attend the hearing.

His solicitor Gwyn Lewis told the court that "my instructions are though (Tevez) was not the driver on that occasion I am not going to argue against a ban on grounds of exceptional hardship."

Separately, Tevez's Porsche Panamera was impounded in Manchester on Nov. 15 because he could not produce a full British driving license.

Two days later, Tevez mimicked driving a car after he scored twice in his team's Premier League win against Aston Villa.

It does mean that going all out to build a huge audience without building in a solid business model from day one has become a riskier bet where success is largely predicated on one of the platform players acquiring the company. For me the sweet spot has now shifted to businesses that are able to able to extract a high ARPU from a focused community. Often times that will mean the companies are ?close to the transaction? or ecommerce related. These businesses can be capital efficient in spite of mobile development costs because they are able to generate meaningful revenues fairly early on and they can have great operational leverage which combined with high ARPUs allows them to generate significant profits from audiences in the tens of millions.

Animals are already dissolving in Southern Ocean acid

In a small patch of the Southern Ocean, the shells of sea snails are dissolving. The finding is the first evidence that marine life is already suffering as a result of man-made ocean acidification.

"This is actually happening now," says Geraint Tarling of the British Antarctic Survey in Cambridge, UK. He and colleagues captured free-swimming sea snails called pteropods from the Southern Ocean in early 2008 and found under an electron microscope that the outer layers of their hard shells bore signs of unusual corrosion.

As well as warming the planet, the carbon dioxide we emit is changing the chemistry of the ocean. CO₂ dissolves in water to form carbonic acid, making the water less alkaline. The pH is currently dropping at about 0.1 per century, faster than any time in the last 300 million years.

Lab experiments have shown that organisms with hard shells, such as corals and molluscs, will suffer as a result. To build their shells, corals and molluscs need to take up calcium carbonate from the water, but more carbonic acid means more hydrogen ions in the water. These react with carbonate ions, making them unavailable to form calcium carbonate.

Aragonite shortage

The most vulnerable animals are those, like pteropods, that build their shells entirely from aragonite, a form of calcium carbonate that is very sensitive to extra acidity. By 2050, there will be a severe shortage of aragonite in much of the ocean.

Aragonite is still relatively plentiful in most of the ocean, but Tarling suspected that some regions might already be affected by shortages.

He visited the Southern Ocean near South Georgia where deep water wells up to the surface. This water is naturally low in aragonite, meaning the surface waters it supplies are naturally somewhat low in the mineral ? although not so much so that it would normally be a problem. Add in the effect of ocean acidification, however, and Tarling found that the mineral was dangerously sparse at the surface.

"It's of concern that they can see it today," says Toby Tyrrell of the National Oceanography Centre in Southampton, UK.

Aragonite-depleted regions are still rare, but they will become widespread by 2050, says Tarling. The polar oceans will change fastest, with the tropics following a few decades after. "These pockets will start to get larger and larger until they meet," he says.

Tyrrell says the Arctic will become undersaturated with respect to aragonite before the Antarctic. Patches of undersaturation have already been seen, for instance off the north coast of Canada in 2008.

The only way to stop ocean acidification is to reduce our CO₂ emissions, Tyrrell says. It has been suggested that we could add megatonnes of lime to the ocean to balance the extra acidity. However, Tyrrell says this is "probably not practical" because the amounts involved ? and thus the costs ? are enormous.

Landry, No. 8 LSU hold off Arkansas 20-13

FAYETTEVILLE, Ark. (AP) ? Jarvis Landry helped LSU keep the SEC championship in reach with a 20-13 win over Arkansas on Friday.

Now the receiver and the rest of the No. 8 Tigers must sit back and wait while their next destination ? perhaps next weekend's SEC championship game ? is played out elsewhere.

Landry's spectacular, reaching, one-handed touchdown catch late in the first half helped LSU (10-2, 6-2 Southeastern Conference) hold off the reeling Razorbacks. It marked the sixth time in eight seasons that the Tigers have reached double-digit wins under coach Les Miles.

LSU must now hope for an Alabama loss to Auburn (not likely) and Texas A&M victory against Missouri (very possible) on Saturday in order to win the SEC West and earn a trip to Atlanta. Even without a division crown, the Tigers could still get an at-large bid to the BCS.

"We'll take the next day and a half or so and watch TV tomorrow and be excited about it, and move forward and see how things go," Miles said.

Zach Mettenberger passed for 217 yards and hooked up with Landry for the play of the day with 1:12 left in the first half to put LSU up 10-0. The Tigers were outgained 462-306 in total yardage, but they were able to hold off record-setting performances by Arkansas quarterback Tyler Wilson and receiver Cobi Hamilton.

Wilson was 31 of 52 passing for the Razorbacks (4-8, 2-6) whose fall from preseason top 10 is now complete. The senior set the school record for career passing yards in the loss, while Hamilton set the school record for receptions in a career with 175.

The records were a bright spot in an otherwise dismal season for a Razorbacks team that struggled mightily following the April firing of former coach Bobby Petrino. Arkansas was 21-5 the last two seasons and entered the season with SEC and national championship expectations, but it was eliminated from the bowl picture following last week's loss at Mississippi State.

"We kind of stuck together (through) all the adversity," Hamilton said. "We're still brothers. We're still the same 2012 team that everybody had high expectations for. But we just stuck together."

The Tigers took at 17-3 lead early in the third quarter after a 1-yard touchdown run by Jeremy Hill, who finished with 77 yards rushing on 18 carries. The touchdown followed an 86-yard kickoff return by Michael Ford to the Arkansas 9.

It also appeared to be the clincher for LSU, though the Razorbacks rallied behind the combination of Wilson and Hamilton.

Wilson passed former Arkansas quarterback Ryan Mallet's mark of 7,493 yards passing in the second quarter, finishing with 359 yards in the game and 7,765 yards for his career, and his 28-yard touchdown pass to freshman Mekale McKay in the third quarter closed the LSU lead to 17-10.

After forcing a Tigers' punt, the Razorbacks used a key fourth-and-1 conversion to set up another scoring opportunity. Wilson found Jonathan Williams for a 37-yard completion on the fourth down at midfield, helping to set up a second-and-goal at the LSU 1.

Arkansas was unable, however, to find the end zone on its next two plays. Interim coach John L. Smith then elected to kick a 17-yard field goal, which backup kicker John Henson converted to close the Tigers' lead to 17-13.

The Razorbacks never did find the end zone again, bringing a likely end to the Arkansas career of Smith ? who was signed to a 10-month contract following Petrino's firing.

"That's the right call," Smith said of the field goal attempt. "I mean, you have to score twice to win it, don't you? At least, I think you had to score twice to win it unless my math was wrong. So do you take it there? You have to take the sure points and then come back you have to score again anyway. So that was the thought, and I think that's the right call."

The Razorbacks had one final chance in the closing seconds, but Wilson's second-down attempt from the LSU 18 was over the head of McKay as time expired.

LSU's final score came on a 27-yard field goal by Drew Alleman with 1:26 remaining, giving it a 20-13 lead. The score came after a key 47-yard third-down completion from Mettenberger to Odell Beckham, who finished with eight catches for 112 yards.

The Tigers led 10-0 at halftime in their first game in Fayetteville since 1992. They did so despite gaining the same 165 yards of total offense as the Razorbacks, whose season-long series of miscues continued in the half.

Arkansas, next to last in the SEC in red-zone offense, squandered three scoring opportunities in the half. Dennis Johnson fumbled near the LSU goal line on the game's opening drive, and kicker Zach Hocker misfired on a pair of field goal attempts before being benched in favor of Henson in the second half.

LSU's first touchdown came late in the first half when Mettenberger found Landry in the back of the end zone for a 22-yard touchdown. Landry had to reach back over his wrong shoulder to stretch out and snare the ball with his right hand, landing well in bounds.

"I felt that the throw kind of kept me in bounds," Landry said. "I felt that if he had led me any, there was a possibility I could have been out of bounds.

"It's just one of those throws where Zach trusted me, and I just went up and made it."

Hamilton finished with 10 catches for 98 yards in his final game at Arkansas, finishing his career with 175 catches. His record broke the former mark of 168 catches, set last year by Minnesota Vikings' rookie Jarius Wright.

Tax increases could factor in MLB negotiations

President Barack Obama's victory over Mitt Romney was of as much interest to baseball's money men as the game scores, given the millions of dollars routinely guaranteed in player contracts these days.

As free agents negotiate deals this offseason, tax policy is an area that comes up along with the usual issues. Some players are wrangling for as much money as they can get before the end of the year to avoid a take hike in 2013.

"Front-loading would make sense if at all possible as tax rates will definitely go up on January 1st on all high-income taxpayers," agent Greg Genske said in an email. "The only question is HOW MUCH will the rates increase????"

This much is known for now: Starting Jan. 1, there is an additional 0.9 percent Medicare tax on wages above $200,000 for individuals and $250,000 for married couples filing jointly under the federal Affordable Care Act, a rise to 2.35 percent.

In addition, the Bush tax cuts are scheduled to expire at the end of the year, which could raise the highest marginal federal tax rate from 35 percent to 39.6 percent ? although a deal between Obama and Congress could change that.

Oakland Athletics general manager Billy Beane figures agents will be on top of the changes ? but the results of negotiations about the so-called fiscal cliff are unpredictable.

"I think if you're hopping around the potential of tax reform, you're probably chasing your tail," Beane said. "If they can predict when something's going to happen, then they're much further ahead than the lawmakers."

With baseball contracts worth as much as $275 million (Alex Rodriguez) and the major league minimum $480,000, tax policy affects every player who spends most of the season in the big leagues.

All-Star shortstop Jose Reyes, who has a $10 million salary next year, was traded from the Miami Marlins to the Toronto Blue Jays. While Florida has no state income tax, Reyes remains a New York resident from his days with the Mets and had high taxes to begin with. Ontario's provincial tax rises to 11.16 percent ? on top of a Canadian federal level as high as 29 percent.

Among states with big league teams, income tax rates go as high as 10.3 percent in California and 8.82 percent in New York. At the other end, Florida, Texas and Washington have no state income tax. The top rate in the District of Columbia is 8.95 percent.

"I like ours; we're a no-tax state," Seattle Mariners general manager Jack Zdurienck said. "When we sit down with players, that's a huge benefit. I think any player out there that has an opportunity to play in a no-tax state gets benefits, enormous benefits. We hope that weighs in our favor."

According to an analysis done by a tax lawyer on the staff of agent Scott Boras, a player with a $10 million salary and average deductions who plays in Florida and is a resident of that state will see his taxes rise from $3.45 million this year to $4.09 million next year under current law. If traded to the Blue Jays, that player's 2013 tax would rise to $4.27 million. And if dealt to a California team, the tax would go up to $4.4 million.

By moving money from salary into signing bonuses, players can sometimes lower their state tax bills. Shifting money into December this year could reduce federal taxes.

"Tax measures are going to be discussed, but change most likely carries compromise on both sides," Boras said. "One thing is clear based on the nation's ballot totals: Many Americans are split on this subject."

In the end, most free agents choose teams based on where they want to play, not on lowering the tax cut on their income.
